DVSA enforcement
DVSA enforcement officers have the power to issue Fixed Penalty Notices to drivers at the roadside. These can pertain to many possible offences, including overloading of a vehicle, vehicle defects, and excessive driving hours.
Fixed penalties will vary in severity depending on the offence, although, at minimum, drivers are likely to receive 3 penalty points for such offences. In the event of more serious offences or non-cooperation from the driver or operator concerned, DVSA enforcement officers have the power to issue Prohibition Notices.
Furthermore, enforcement officers may choose to interview drivers at the roadside. These interviews are carried out with drivers under caution and may be used as evidence.
In the event that a driver or operator is perceived to be non-compliant, the enforcement officer has the power to report the offence to traffic commissioners who may then carry out a public inquiry where, if deemed necessary, regulatory action can be taken against the operator’s licence.
