{"id":4206,"date":"2023-07-07T05:50:00","date_gmt":"2023-07-07T05:50:00","guid":{"rendered":"https:\/\/simplylaw.waydevelopers.com\/england-wales\/failing-to-name-the-driver-understanding-the-penalties-and-defences\/"},"modified":"2024-04-11T14:57:42","modified_gmt":"2024-04-11T14:57:42","slug":"failing-to-name-the-driver-understanding-the-penalties-and-defences","status":"publish","type":"post","link":"https:\/\/simply.law\/england-wales\/blog\/failing-to-name-the-driver-understanding-the-penalties-and-defences\/","title":{"rendered":"FAILING TO NAME THE DRIVER: UNDERSTANDING THE PENALTIES AND DEFENCES"},"content":{"rendered":"<p>Section 172 of the <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1988\/52\/contents\" target=\"_blank\" rel=\"noopener noreferrer\">Road Traffic Act<\/a> imposes a legal obligation on the registered keeper of a vehicle to provide the driver\u2019s identity at the time of an alleged road traffic offence.<\/p>\n<p>Failure to name the driver can face severe penalties, including:<\/p>\n<ul>\n<li>six penalty points on your licence and,<\/li>\n<li>up to \u00a31000 fine.\u00a0<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<p><strong>The legal obligation<\/strong><\/p>\n<p>It is important to note that nominating either yourself or another as the driver at the time of an alleged offence is not the same as confessing to having committed the offence itself.
