A handheld mobile phone is defined as such if it “\u2026is or must be held at some point during the course of making or receiving a call or performing any other interactive communication function.” If a phone is being held whilst driving then it is being \u2018used’, regardless of which function it is performing, and the driver will have committed an offence.<\/p>\n
