If they have not assigned lasting power of attorney or enduring power of attorney to someone, then making decisions about their welfare or finances can be difficult. The Court of Protection was set up under the Mental Capacity Act 2005 primarily as a safeguarding measure to protect those who have lost capacity.<\/p>\n<h2>What can the Court of Protection make decisions about?<\/h2>\n<p>The court is a specialised one and it has a wide-ranging remit. Once an application to the court has been made, it can make decisions about:<\/p>\n<ul>\n<li>the capacity, or otherwise, of a person<\/li>\n<li>Enduring Power of Attorney and Lasting Power of Attorney<\/li>\n<li>personal welfare, property and financial affairs<\/li>\n<li>medical intervention, procedures and any ongoing care<\/li>\n<li>using an independent mental capacity advocate<\/li>\n<li>removing or appointing attorneys<\/li>\n<li>challenging decisions about the depravation of liberty<\/li>\n<\/ul>\n<p>Simply.Law member solicitors will be able to explain the purpose and function of the Court of Protection in relation to your particular query.
