Suffering <\/tspan>injustice within that working role or facing unfair situations in the workplace can be <\/tspan>extremely distressing. The law recognises this and one of its functions is to protect <\/tspan>employees by upholding certain rights.<\/tspan><\/text> <\/rect> Broadly speaking, employment law is about the legal rights of employers and <\/tspan>employees. As well as the rights enshrined in statute, case law also has a major <\/tspan>part to play in terms of creating precedents in what can be a very complex area. <\/tspan>This provides a comprehensive backdrop for those seeking guidance on their <\/tspan>employment law issue. <\/tspan>Simply.Law has a number of member lawyers who have an expert working knowledge <\/tspan>of this field and we will be able to match your personal circumstances to the <\/tspan>lawyer best suited for your case.<\/tspan><\/text> <\/rect> The first thing to do is seek some advice from an employment law solicitor. If you\u2019re <\/tspan>thinking of bringing an action against your employer, the chances are that you <\/tspan>might feel a bit daunted. Taking early legal advice can strengthen your claim and <\/tspan>provide you with the support that you need. <\/tspan><\/text> <\/rect> Then there are certain steps you should take, starting with the ACAS code of <\/tspan>practice. This is a code which sets out the correct way to tackle employment issues, <\/tspan>and whilst it\u2019s not compulsory, if your claim should go to an Employment Tribunal, <\/tspan>the bench may look at whether you followed this or not when deciding how much <\/tspan>compensation to award. Your employer should also have a formal grievance <\/tspan>procedure to follow. <\/tspan><\/text> <\/rect> Certainly not. There has been a big surge in tribunals in recent years as employees <\/tspan>become more aware of their rights. Statistics show that employers are also taking <\/tspan>the procedure more seriously now. <\/tspan><\/text> <\/rect> During the annual period 2014-2015, 75% of claimants were <\/tspan>represented by a lawyer. This is higher than the figure for 2013-2014, <\/tspan>where only 71% of claimants had a lawyer acting for them.**<\/tspan><\/text> <\/g> <\/rect> Claims will be deemed to have been received by the Employment Tribunal once the <\/tspan>relevant fee has been remitted or paid and the Tribunal has accepted the claim as a <\/tspan>valid one. A claim can be single or multiple; if it\u2019s the latter it will be two or more <\/tspan>people bringing a claim based on the same facts against a common employer. <\/tspan><\/text> <\/rect> During 2014-2015, Employment Appeal Tribunals heard 1,200 cases <\/tspan>against decisions, which was 30% less than the previous year.**<\/tspan><\/text> <\/rect> **www.gov.uk<\/text> <\/rect> It\u2019s worth bearing in mind that Employment <\/tspan>Tribunals can increase compensation by up to <\/tspan>25% if they find that the employer concerned <\/tspan>has \u2018unreasonably\u2019 failed to follow the ACAS <\/tspan>code. Similarly, they can reduce the award by <\/tspan>up 25% if the employee has failed to follow <\/tspan>the code.*<\/tspan><\/text> <\/rect> Employment law has a wide remit but there are some areas where <\/tspan>it is more commonly used than others. All the circumstances will be <\/tspan>examined and a decision made accordingly.
