{"id":5021,"date":"2017-02-03T16:16:48","date_gmt":"2017-02-03T16:16:48","guid":{"rendered":"https:\/\/simplylaw.waydevelopers.com\/england-wales\/wiki\/using-caveats-correctly\/"},"modified":"2024-04-21T10:26:59","modified_gmt":"2024-04-21T10:26:59","slug":"using-caveats-correctly","status":"publish","type":"articles","link":"https:\/\/simply.law\/england-wales\/articles\/using-caveats-correctly\/","title":{"rendered":"The use of Caveats"},"content":{"rendered":"<p>The case of Elliott v Simmonds [2016] has highlighted the cost consequences when a Caveat is used incorrectly.<\/p>\n<p>In this case, Kenneth Jordan, a self-made millionaire, left his whole Estate to Ms Elliott, the Claimant in this matter.\u00a0 The Defendant, Ms Simmonds, an illegitimate child of Mr Jordan was left nothing in the Will and so she lodged a Caveat against the Estate.<\/p>\n<p>Ms Simmonds raised various allegations against the Will.\u00a0 However, she took no steps to bring a claim or produce any evidence to support such allegations.\u00a0 The \u201cWarning off\u201d procedure was therefore followed and an \u201cAppearance\u201d entered by Ms Simmonds, resulting in the Caveat being made permanent.<\/p>\n<p>This left Ms Elliott with no option other than to issue Court Proceedings to \u201cprove\u201d the Will.\u00a0 This was even after providing Ms Simmonds with evidence that the Will was valid, including various medical records and documents from the Will writer who prepared the Will.<\/p>\n<p>Following the issue of Court Proceedings, Ms Simmonds did not file a Defence, but simply exerted her right to enter a \u201cpassive defence\u201d in accordance with the Civil Procedural Rules (CPR), part 57.7 (5).\u00a0 This means that the burden is placed on the Claimant, Ms Elliott in this case, to prove the Will at Court.<\/p>\n<p>In addition, CPR Part 57.7 (5)(b) allows the Defendant, providing they give notice, to avoid a costs order being made against them, unless <em>\u201cit is considered that there was no reasonable ground for opposing the Will\u201d. <\/em><\/p>\n<p>At trial, the Judge found no evidence to dispute the validity of the Will and therefore proved the same.<\/p>\n<p>Following the Judgment being made, Ms Elliott made an application for costs against Ms Simmonds on the basis that she had acted unreasonably in opposing the Will.\u00a0 It was highlighted that Ms Simmonds had been provided with all the required evidence supporting the validity of the Will before Court Proceedings were even issued.\u00a0 Further, Ms Simmonds had produced no evidence to support her position.<\/p>\n<p>The Judge agreed with Ms Elliott and ordered full costs in the matter against Ms Simmonds amounting to \u00a365,000.<\/p>\n<p>The importance of this case is to seek expert legal advice as early as possible, to ascertain whether a Caveat is the appropriate course of action, and to avoid a substantial costs orders being made against you.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A recent case has acted as a warning of how a caveat can be used incorrectly.<\/p>\n","protected":false},"author":46,"featured_media":10470,"parent":0,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","format":"standard","meta":{"_acf_changed":false,"_joinchat":[],"footnotes":""},"categories":[12372],"tags":[11925,11927,11926,11928,8524],"class_list":{"0":"post-5021","1":"articles","2":"type-articles","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-contesting-a-will","8":"tag-caveats","9":"tag-civil-procedural-rules","10":"tag-elliott-v-simmonds-2016","11":"tag-expert-legal-advice","12":"tag-will"},"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v23.4 (Yoast SEO v27.4) - https:\/\/yoast.com\/product\/yoast-seo-premium-wordpress\/ -->\n<title>The Cost Consequences of Misusing a Caveat in Will Disputes - Simply Law England Wales<\/title>\n<meta name=\"description\" content=\"Understanding the cost and consequences of using a Caveat incorrectly in a Will dispute.
