{"id":4725,"date":"2016-09-19T16:34:30","date_gmt":"2016-09-19T16:34:30","guid":{"rendered":"https:\/\/simplylaw.waydevelopers.com\/england-wales\/wiki\/commercial-dispute-resolutions-for-new-year\/"},"modified":"2023-09-12T16:29:02","modified_gmt":"2023-09-12T16:29:02","slug":"commercial-dispute-resolutions-for-new-year","status":"publish","type":"articles","link":"https:\/\/simply.law\/england-wales\/articles\/commercial-dispute-resolutions-for-new-year\/","title":{"rendered":"New Year\u2019s (Commercial Dispute) Resolutions"},"content":{"rendered":"<p style=\"text-align: justify;\">We all know the annual ritual \u2013 new year arrives \u2013 we recognise the opportunity to make changes for the better \u2013 we come up with a set of New Year\u2019s Resolutions (some achievable, some aspirational) \u2013 and that\u2019s it \u2013 \u201cjob done\u201d \u2013 virtuous feeling envelopes us and then\u2026. we forget about them (apart from the occasional guilty moment when we do remember what we promised to ourselves and the fact that we only did it for a week or haven\u2019t done anything at all).\u00a0<\/p>\n<p style=\"text-align: justify;\">So what\u2019s this got to do with commercial dispute resolution?\u00a0<\/p>\n<p style=\"text-align: justify;\">Well, because most clients may not experience the legal process that often, they do not have a clear reference point from which to consider what changes might be prudent for them to make.\u00a0 On the basis of our experience, you are not going to be able to eliminate the potential for disputes to arise, but here are a few suggestions as to possible New Year\u2019s Resolutions that, if adopted, are likely to help you achieve a better outcome for your business if a dispute should come about:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Understand and manage your level of risk \u2013 when taking on a new customer or contract, think about the risks and the \u201cwhat if\u2019s\u201d in case things might not go to plan (eg. how serious a problem would it be if you were to be late in delivering what you have promised?)<\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li>Get it in writing! \u2013 for example, if someone says they will do x\/y\/z but you don\u2019t have an accurate written record of what x\/y\/z are, how can you hope to get your money back when some part of what was promised is not delivered?\u00a0 Confirm in writing things that have been agreed verbally.<\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li>Be vigilant for standard terms and conditions.\u00a0 Make sure that if you are agreeing to another party\u2019s standard terms and conditions, that you have seen them, read them and understood them and, if there is anything you are not happy to agree to, negotiate an acceptable variation.
